Divorce Assistance

First and foremost, before we go any further... I am NOT an attorney, nor will I give any advice on how to proceed with your divorce, whether it is contested or not. What I WILL do is prepare the paperwork for you, and direct you to a simple, easy to understand set of step by step instructions on when and how to file them, among other vital information. If you have ANY questions or concerns, PLEASE see an attorney.

Divorce is never an easy thing to do - and sometimes it isn't fair. If you have children or property and are unable to agree on how to deal with the division of those responsibilities, you should see a divorce attorney to protect your rights. We cannot give you legal advice in any form. However, for most divorces where you and your spouse are in agreement on the division of property and child custody, we can provide great assistance.

Because of the legal difficulties that can arise in contested divorces, we can only help with divorces where the parties agree. If your divorce is contested or becomes contested after it begins, we recommend that you contact an attorney for assistance. AGAIN, WE DO NOT OFFER LEGAL ADVICE.

Specific forms must be filled out properly and filed with the court at specific points on the divorce timeline. We can handle the paperwork hassles for you for a very reasonable fee. We fill out the proper paperwork with the information you provide us. The paperwork must then be filed at the County Clerk's office in your county. The filing must be done in person and the filing fee paid at the time of filing. We can provide filing services and summons service on your spouse for a low additional fee in Grays Harbor County, WA, only.

The divorce papers must be served on the Respondent (your spouse) by someone over the age of 18 other than yourself. You must arrange for someone to hand the papers to your spouse, or you can sometimes have the local county sheriff perform that task for a small fee, although this may take a few weeks to accomplish. In some cases, we can arrange the service with a local company who specializes in this service, for an additional fee.

The waiting period for a dissolution of marriage in Washington state is 90 days. In California, it is six months; other states have varying periods. This means the process takes no less than 90 days before the judge will sign the final decree. This is a minimum period and is intended to allow time for a reconciliation between parties. The process could take much longer if any aspect of a dissolution is contested and the parties have difficulty reaching an agreement.

Our low fee of $150.00 covers collecting information and the proper forms for your county, filling out the necessary forms for your case, and delivering the finished product to you. The fee must be paid up front. If, however, at any time during the process of preparing your paperwork, it is determined that you desire or need to have an attorney complete the process, our fee will be pro-rated based on the amount of work already performed and the balance will be returned to you.

Each individual county of each state may (and probably does) require a filing fee which must be paid at the time of filing. This fee is not paid to us, but is a separate fee paid directly to the court (although you can pay us and we will pay the filing fee for you if you chose to have us file the papers). Some counties make provision to waive or adjust the fee for those who are unable to pay; the requirements differ.

Let us reiterate - we prepare the papers necessary for your uncontested divorce (with or without children). You arrange for the filing (through us or on your own), we make any necessary adjustments to the paperwork that may come up. We do not provide legal advice in any way, shape or form. You must proofread the forms and make sure the information is correct. The final responsibility for the accuracy of the information provided lies with you as we can only go by what you provide to us. Corrections and adjustments cheerfully made when necessary before the papers are filed

We will also set up email and/or phone reminders to you of important dates for the next steps.

So... we can do a lot to help make the process less stressful. If you have any questions or comments, please do not hesitate to contact us by e-mail or phone.
